Variance

Modification of zoning regulations governing yard setbacks, lot coverage, bulk, density, landscaping and green space requirements. Variances are granted based on a demonstrated hardship relating to the circumstances of a specific property. The full criteria used to determine the existence of a legitimate hardship can be found in Section 20-5.2 of the Unified Land Development Code. Variance requests must be presented before the Planning Commission for recommendation prior to presentation to the Board of Appeals.

Approved by: Board of Appeals, after a recommendation from the Planning Commission.

Fee Schedule

  • Residential, Single-Family: $550
  • Residential, Multi-Family: $1,000
  • Non-Residential: $2,500
  • Floodplain: $2,300

Note: All fees include a $30 zoning sign and advertising fee when required.
